		<description>To answer your question, the proposed waiver pre-approval policy will not apply to parents of U.S. citizens.  The policy does not create a new waiver, it would simply create a new pre-approval process for the existing I-601 waiver.  An I-601 waiver must be approved to overcome the 10-year bar to return that is triggered when a person leaves the U.S. after having accrued more than one year of unlawful presence.  With the waiver approved, a person with an current approved  family-sponsored petition can enter the U.S. as a permanent resident.  The existing waiver is not available to parents of U.S. citizens, only to spouses and children of citizens and permanent residents.  The proposed waiver pre-approval process is further limited to spouses and children of U.S. citizens.  It is a far more limited remedy than people have been led to understand, but will still benefit many thousands of people. 

The other point to make is that an applicant for the waiver would still be required to leave the U.S. to finish processing the visa.  After leaving, there is no guarantee the applicant wouldn&#039;t be stuck outside the U.S. for some reason unrelated to the unlawful presence bar, such as having previously been deported or convicted of certain crimes.  Many applicants will not understand these complexities and will be stuck outside the U.S. </description>

Whether you like it or not, the terms &quot;alien,&quot; &quot;immigrant,&quot; &quot;illegal alien,&quot; and &quot;illegal immigrant&quot; are long-established LEGAL terms.  They may not make you feel all fuzzy and warm inside, but they are not meant to.  The term &quot;economic refugee&quot; is just a distracting, politically correct attempt to morally justify something that the laws of most countries forbid.  Whether it&#039;s Guatemalans sneaking into Mexico, Burmese working in China without permits, or Americans overstaying their tourist visas in Thailand, they are still considered illegal aliens.  It doesn&#039;t matter if they are doing it for &quot;economic purposes&quot; or otherwise.

The link you supplied seems to be discussing &quot;misconceptions&quot; regarding people who enter a country illegally.  Seems like a different discussion to me, perhaps one that would be the successor to this one.  But since you brought it up, maybe I should go comment over there about how it doesn&#039;t matter why they are breaking the law, it is still breaking the law.  It&#039;s like going to traffic court for a speeding ticket and telling the judge, &quot;I&#039;m guilty with an explanation, your honor.&quot;  I guess it&#039;s up to the judge to decide if doing 100 mph on the freeway because you were late to work and didn&#039;t want to get fired is just cause or not.  

Speaking of which, most illegal aliens who are arrested do get their day in court.
